Drug charges can come in a wide variety of forms, but the end result is almost never favorable. Even a seemingly simple marijuana possession charge can result in serious fines and have a negative effect on you for the foreseeable future and as the charges become greater, so do the potential penalties. If you are facing any type of drug charges, even if the potential penalty for a conviction or guilty plea doesn’t seem too severe, you should enlist the help of an experienced Colorado defense attorney.

A drug conviction can stay on your criminal record and affect you in the future when trying to get a job, when trying to secure a loan or when trying to obtain financial aid. If fail to fight the charges with a solidly constructed defense or if you take a guilty plea in order to simply try and put the event behind you without having to sit through a lengthy trial, your future could certainly suffer.

An experienced Colorado defense attorney may be able to immediately cast doubt on possession charges based on the available evidence. A good Colorado defense attorney will be fully aware of the most effective methods of defense in cases where charges of drug possession are filed. Having that experience and knowledge at your disposal is the best possible way to ensure that your future is not negatively effected by the potentially serious penalties that often go along with charges of drug possession.

No matter which state you live in, a conviction on assault charges can bring about some very serious legal penalties. Even a third degree assault charge, which is a misdemeanor in most states, can carry a penalty of up to two years in prison. Felony assault charges can have much more severe penalties and much longer possible prison terms, which is why you need to reach out to an experienced defense attorney if you’ve been charged or are under investigation for any level of assault charge.

There are a number of variables considered during an assault case, and constructing the most appropriate and most effective defense requires an in depth knowledge of criminal law and litigation experience. Attempting to get through a hearing involving any type of assault crime without a qualified and experienced defense attorney is a huge mistake that will likely result in the receipt of some very serious punishments.

Due to the fact that assault is not a victimless crime, you will have to build a defense that capably handles the evidence gathered by law enforcement officials, the testimony of the victim and the testimony of witnesses. Constructing an effective and believable defense requires not only a great understanding of the laws in your area, but the ability to determine how the prosecution will handle the pursuit of the conviction. A criminal defense attorney with experience defending clients in assault cases will be able to build an effective defense with these things in mind.

A felony assault charge could have a seriously negative impact on your life moving forward, which is why you’ll want to do everything in your power to have the charges reduced or dismissed. You can often get criminal charges reduced if you can negotiate a plea bargain, but you need an attorney to advise you on the best way to plea. An experienced criminal defense attorney will have cultivated professional relationships with prosecutors and judges in order to be able to help their clients reduce charges or make favorable pleas to lesser charges.

In order to leave the courtroom after an assault hearing with the most favorable results, you need the best possible defense, which can only come from a highly qualified and experienced defense attorney who knows local prosecutors and judges. If you’ve been involved in a fight or altercation of any kind, don’t wait until the charges have been filed in order to start building your defense. Reach out to an experienced defense attorney right away.

The law in many states takes domestic violence charges very seriously. Law enforcement and court officials are understandably concerned with protecting the rights of alleged victims. Even when there are no signs of physical injury present, domestic violence charges can still be filed on behalf of the alleged victim. Judges will often administer serious penalties upon a conviction for domestic abuse or other related charges. If police get called to a scene where domestic abuse is suspected, it almost always results in an arrest, and that arrest can result in a lengthy stay behind bars for the accused.

Because these types of charges are taken so seriously by law enforcement officials and court systems across the country, domestic violence charges can never be taken lightly. If you’ve been charged or suspect that you will be charged with a crime like domestic abuse, you need a qualified and experienced defense attorney on your side. A defense attorney with experience in these kinds of cases will structure the best possible defense against these serious criminal charges. Having that knowledge of the law and experience in the court room setting is invaluable if you hope to walk away from your hearing without serving an extended period in county jail.

Attorneys usually begin building a defense by closely examining the details of your case to be able to argue for your innocence in court. A defense attorney with a wealth of experience defending against assault charges will know exactly what information will be the most relevant to your defense and be able to structure those details in the most efficient and most effective defense. Defense attorneys will also generally scrutinize witness testimony in an effort to unearth lies, half-truths or inconsistencies so that they can cross examine witnesses in the court room and use witness testimony to prove your innocence.

In cases of domestic abuse or any kind of criminal cases that involve families, a defense attorney will also be able to help you even before your day in court. Your defense lawyer should be present during the investigation of your case because they can advise you on how to talk to law enforcement. Often, the police will pressure individuals accused of domestic violence into telling their side of the story, and you should never do this without an attorney by your side.

No one wants to spend time in prison, but the possibility of facing a jail term for a domestic assault charge where no one was even injured can be incredibly disheartening. A good defense attorney will ensure that your side of the story is heard in court and that all of the relative details of the case are brought to light, so you can feel confident that you’ll receive a fair and just trial and not be punished for a crime that you did not commit.

Depending upon the amount of drugs found on your person, in your car or on your property, you could be in for some serious punishments if you are convicted on drug possession charges. Even a small amount of illegal or illicit drugs could result in heavy fines, probation or a prison term. In order to fight a drug possession charge as effectively as possible, you need an appropriately structured defense, and the best way to get that is with the help of an experienced defense attorney.

A clever and experienced defense attorney will most often begin a drug possession case by calling the actual possession of the drug into question. If there were other people with you when you were stopped, if you were in a car belonging to another person or if there were others in your home when the illegal drugs were found, then there is a chance that the drugs found on the scene may not even be yours. If the prosecutor cannot clearly prove that the drugs that were found belong to you, there is a very good chance that your charges could be reduced or dismissed.

A good defense attorney will also examine the information available to determine if the arresting officer obtained the evidence in a legal manner. Police must follow strict procedures when searching for illegal substances during an arrest so that they don’t violate the accused’s Fifth Amendment Constitutional rights. The law takes search and seizure rights very seriously, and if your search and seizure rights were violated, your charges can be dismissed. Attorneys with experience in drug cases will also have a thorough knowledge of search and seizure rights, and your defense lawyer can prove if your rights have been violated. If a law enforcement official did not clearly follow all procedures and adhere strictly to the law in his or her search and investigation, there is a chance that some or all of the evidence obtained will not be admissible which could have a seriously negative impact on the case for the prosecution.

If you’ve been charged with drug possession, no matter whether you are facing misdemeanor or felony drug possession charges, it is critical that you reach out to a qualified defense attorney that has experience in drug related charges within the jurisdiction that you were arrested in. You also shouldn’t wait to contact an attorney because they can help you from the very beginning of your case by advising you on how to speak with the police during their investigation of your drug charges.

A seemingly small bag of marijuana can easily be turned into a wide array of criminal drug charges from misdemeanor possession to felony distribution, depending upon the course of the arresting officer’s investigation. Drug charges can have serious consequences for the accused, including mandatory time in prison, probation and large fines. Even a misdemeanor possession charge can result in some serious legal consequences, but these consequences can become more severe if a felony charge is leveled.

There is no need to feel pressured by the prosecution to simply accept whatever penalty they might hand down for the charges filed against you. Any drug charge can result in negative repercussions, and you should do everything in your power to ensure that you receive a fair trial. Enlisting the help of an experienced criminal defense attorney as soon as possible following your arrest will ensure that you have a solid defense prepared by the time your trial is scheduled to take place.

A conviction on drug charges is a very dangerous prospect, especially for someone who has already faced and been convicted of a drugs or weapons charge previously. These sorts of situations can easily lead to felony drug charges. A felony drug charge can remain on your criminal record and have a serious effect on a number of areas of your life in the future. In addition to the fines and jail time that you could possibly face at the time of conviction, a felony drug charge may prohibit you from getting your dream job or getting financial aid for college at some point down the road. This is why you need to reach out to an experienced criminal defense attorney as soon as possible following a charge for a drug related offense.

Felony drug charges are usually leveled for cases where law enforcement thinks that the accused is intending to manufacture or distribute drugs, as well as in cases of possession of a large amount of drugs. A criminal defense attorney with experience handling drug possession, manufacturing or distribution cases will be amply prepared to structure a sound defense for your case based upon the information available. A good criminal defense attorney will likely have experience defending dozens or possibly hundreds of clients who’ve been in your exact position and he or she will be able to use that wealth of experience gathered during those trials to present the best possible defense for your case.

To minimize the legal consequences for a drug conviction, a defense lawyer is necessary. Anyone who has been charged with a drug crime needs to contact a defense attorney as soon as they know about the charges so that an attorney can begin working on their defense.

There aren’t many things out there that are as annoying to a driver as getting an undeserved traffic ticket. The majority of drivers will simply cart the ticket home and send in a check to pay the fine without really considering showing up to court to defend themselves against traffic violations, but in many cases this can be a serious mistake.

A traffic ticket can result in more than just that seemingly simple fine. In states that use a driver’s license point system, a traffic ticket can result in points on your driver’s license that will potentially affect your car insurance premiums for the foreseeable future. Usually, accruing too many points on your license can also result in a suspended license or other restrictions on your driving privileges. When you consider other legal penalties associated with traffic tickets, fines may seem like a small price to pay. Paying a fifty, seventy five or one hundred dollar fine might seem reasonable to make a minor headache go away, but drivers need to realize that the admission of guilt in traffic court can cause unforeseen legal problems.

If you’ve been cited for a traffic or moving violation and don’t feel as though the charges are just, you shouldn’t just blindly pay the fine and move on. To address any kind of traffic offense, you should reach out to a qualified defense attorney to fight the charges. Based on the information available, a good defense attorney may be able to work with prosecutors to get your charges dropped or possibly even dismissed, which could save you quite a bit of grief and money moving forward. An experienced defense attorney will act in your best interests to minimize the possible points that will be applied to your driver’s license and lower the fines attached to the traffic charge to a more manageable level.

In order to properly defend yourself against traffic tickets and moving violations, you need to have a deep understanding of the traffic laws and the procedures of traffic court. A defense attorney will have this understanding and be able to help you, and an attorney can also use his or her knowledge of traffic stop procedures to defend you in court. Attorneys who have experience in traffic court will be able to reconstruct the accident or traffic stop that led to your charges. If you’ve been charged with a serious traffic offense, don’t blindly pay the fine and admit guilt, reach out to an experienced defense attorney for a consultation.

Getting arrested for suspicion of DUI or DWI is a very serious situation. Operating a vehicle while under the influence of alcohol or drugs can result in very serious penalties, including jail time, a suspended driver’s license and heavy fines. These penalties get worse if there are other traffic violations associated with a DUI charge. If you were involved in an accident that caused property damage or injury in addition to being suspected of DUI, the possible legal penalties you’ll face could be much more severe.

When you’ve been arrested for suspicion of DUI, the best step to take to ensure a fair trial with a livable outcome is to enlist the help of an experienced defense attorney. Many people think that they can get through a DUI case without an attorney, but a defense lawyer can mean the difference between spending time in jail and simply paying a fine. A good defense attorney who has experience in dealing with these types of cases is critical to establishing a solid defense when fighting charges like DWI, aggravated DWI or vehicular assault.

A defense attorney will scrutinize the available evidence to find bits and pieces of information that can be used to cast doubt on the prosecution’s case. Often, defense attorneys with experience in major traffic offenses like vehicular assault or Driving Under the Influence can reconstruct the accident or the conditions that led to your traffic stop in order to prove your innocence. A defense lawyer can also bring up mitigating circumstances in your defense. If you’ve got a clean driving and criminal record, your defense attorney will be able to highlight that information in an effort to reduce the possible penalties that you’ll face.

In many DWI cases there is just too much in the way of solid evidence for the court system to ignore. In these cases, a good defense attorney can be a critical asset if the evidence is strong. If your defense attorney feels as though a DUI conviction is imminent, he or she may be able to negotiate a plea bargain with the prosecution in order to get the penalties you’ll face reduced. An experienced DUI attorney will have relationships with local prosecutors and judges that will allow you to make a favorable deal.

A DUI conviction in which you face the stiffest possible penalties could affect you for years to come in many different ways. If you’ve been arrested for DUI and feel as though the prosecution has a good case against you, reach out to a qualified defense attorney for a consultation immediately.

Very often, law enforcement officials use saturation checkpoints or other types of periodic, roadside sobriety checkpoints to charge suspected drivers with DUIs or DWAIs. These checkpoints play an important role in officials’ efforts to maintain safe roadways and prevent life-threatening automobile wrecks. Checkpoints aside though, law enforcement officials have other means of keeping roadways clear of intoxicated drivers.

While DUI saturation and sobriety checkpoints serve as a common and effective way of identifying which drivers pose a threat to the safety of others, the checkpoints have drawbacks, and as such, they’re not the only tool available to law enforcement officials have at their disposal for keeping roadways clear of dangerous drivers. Law enforcement officials can also pull-over intoxicated drivers if the officers have reasonable suspicion that the drivers’ judgment or abilities have been impaired due to alcohol or drugs.

Unfortunately, for those drivers who’ve been wrongfully charged with DUIs or DWAIs, a wide-range of behaviors fall into the category of those driving behaviors that officers associate with suspected DUI offenders. To explain, the National Highway Traffic Safety Administration provides a list of behaviors or “symptoms” that officers have cited for pulling over drivers which they reasonably suspect have been driving under the influence. While the connection between some of these behaviors and intoxication—in many cases—appears painfully obvious, in other cases, the connection might not seem apparent.

Driving Behaviors or “Symptoms” that Provide Officers with Reasonable Suspicion

Turning with wide radius

Straddling center or lane marker

Appearing to be drunk

Almost striking an object or vehicle

Weaving

Driving on other than designated roadway

Swerving

Slow Speed

Stopping (without cause) in traffic lane

Drifting

Following too closely

Tires on center or land marker

Braking erratically

Driving into opposing or oncoming traffic

Inappropriate stopping

Inconsistent signaling

Headlights off

Accelerating or decelerating rapidly

Turning abruptly or illegally

If you or someone you know has been charged with a DUI (driving under the influence) or a DWAI (driving while ability impaired) then you should contact a DUI criminal defense attorney as soon as possible. Because the types of behaviors associated with DUI charges covers a rather tremendous spectrum of driving behaviors—and is therefore, a likely inaccurate gauge at times—you should make sure you have a seasoned DUI criminal defense attorney to ensure you don’t end up with a conviction you don’t deserve.

In 2009, The Denver Post published a story about a multiple DUI offender whose persistence in drinking and driving amassed 18 offenses over a period of 27 years. His behavior eventually culminated in the death of his ex-wife who was a passenger in the car with him at the time of his last incident

While the years of fines, jail sentences, and other penalties associated with DUI and DWAI convictions might seem like strong-enough deterrents to encourage individuals to curb such behavior, these legal consequences—apparently—do not provide sufficient motivation. Very often DUI offenders—despite having served sentences or having paid hefty fines—end-up back on the roads engaging in the same illegal and dangerous behavior they did prior to their original offense. To explain, according to information provided to The Denver Post by the Division of Motor Vehicles, over 50,000 individuals in the state of Colorado have had three or more DUI offenses, and 51 individuals have had ten or more DUI offenses. In the case of the particular driver reported by The Denver Post, he received multiple DUI charges (and subsequent convictions) prior to the final vehicular homicide DUI incident involving his ex-wife.

Sadly, a significant number of offenders do not alter their risky behavior, and as such they end-up seriously injuring or even killing other motorists and passengers—including members of their own family. As such, these offenders end-up facing vehicular homicide-DUI charges. While DUI and DWAI charges result in serious enough consequences, those consequences resulting from vehicular homicide should give individuals pause before getting behind the wheel of a vehicle. Not only do convicted vehicular homicide offenders face extended jail and prison sentences (as well as enhanced fines), they also face—potentially—a lifetime of guilt and heartache knowing that they’ve taken an innocent life.

While individuals who plan on drinking should take every precaution to avoid getting behind the wheel of a vehicle, the reality of the situation is that alcohol and other substances impair peoples’ judgment and ability to make good decisions. As such, a qualified Colorado DUI criminal defense attorney should be sought-out by anyone facing charges and a potential DUI conviction.

If you’ve been charged with a DUI in the state of Colorado—or in any other state for that matter—then you probably have innumerable questions concerning the possible consequences should a judge convict you. For instance, you may have questions about whether or not you’ll spend time in jail or whether or not you’ll keep your license. Furthermore, should your particular circumstance have a unique character—such as, a law enforcement officer charged you while you were out of state and this is you’ve been previously convicted of driving under the influence—then you will undoubtedly find yourself in the need of legal aide. Indeed, even if the circumstances surrounding the charge do not seem particularly unique, you should still do everything within your power to contact a DUI criminal defense attorney as soon as possible.

By obtaining a solid defense—depending on the nature of your alleged offense—your chances of a judge reducing your sentence or altogether dismissing your charges significantly improves. As such, you should never hesitate to reach-out to a qualified Colorado DUI defense attorney immediately after you’ve received a DUI or DWAI charge. While some people may worry or have a deal of great anxiety at the prospect of hiring an attorney to represent them in a court of law, those individuals should consider that the costs of simply accepting whatever charges are thrown their way can be significantly greater than any attorney’s fees. For instance, an offense can easily result in fines exceeding $1,000.00. Also—something else to consider—is that the costs don’t necessarily have dollar signs attached to them. Many individuals convicted of DUI or DWAIs must give-up their valuable time performing community service, attending alcohol-awareness class, or spending time in jail. Furthermore, they end-up living with a stigma that affects them in the not only in their day-to-day interactions with and among members of their communities, but also in their professional interactions. For instance, how might a DUI or DWAI conviction affect you if your career if your profession requires that you have a clean driving record?

In the end, should you find yourself facing DUI or DWAI charges, you’ll want to make sure you have the best defense available to protect yourself from consequences that may follow you for a lifetime. While legal fees sometimes scare alleged offenders away from a seeking a quality defense, those who are wise will understand that the potential consequences of not having a good defense in your corner far outweigh any legal fees. Having a resource on hand that knows the rights afforded to you under the law will prove to be one of the most valuable investments you could ever make.
